LITIGATION

Sometimes, disagreements cannot be resolved by the parties themselves and court intervention becomes necessary.  We zealously represent our clients in New York and New Jersey state and federal courts.  Alexander Suslensky is admitted to practice in New York State courts, New Jersey State courts, United States Supreme Court, United States District Court – Southern District New York, United States District Court – Eastern District New York, United States District Court – District New Jersey.

Alex’s “War Story”:  “Sadly, too many lawyers focus more on generating higher fees rather than looking out for the best interests of their clients.  An individual who was being sued asked me to represent her.  I reviewed the facts of her case and noted that it may be possible for her to earn a very quick victory by showing that the plaintiff (the person suing her) could not sue her in that particular state.  However, I did not have much litigation experience at the time and so I told the individual that she should consult with a more experienced attorney.  A week later, she called me crying and informed me that the “more experienced attorney” informed her that no quick victory was possible in her case and that it would cost her over $35,000 in legal fees.  The individual did not have such funds but could not afford to lose the law suit either.  I decided to take on her case and try my “quick victory” theory.

During our first court appearance, the plaintiff’s attorney introduced himself to me as “the most knowledgeable and experienced lawyer” in that particular area of the law in that particular county.  He then proceeded to tell me that I had no chance to prevail in the case.  I politely shook his hand and faced the judge.  After just two hearings, the case was dismissed.  The judge agreed with me that this law suit could not proceed in that state.  My client paid me just over $5,000.  Although the plaintiff could have started the case in another state, he chose not to because apparently he was so disillusioned with the ‘legal system’ that he never bothered to sue my client again anywhere else.  Case closed.”
